Mediation and arbitration typically affords a less costly alternative to a court trial.
In mediation, the parties to the lawsuit use a mediator, usually an attorney not involved in the matter, to try to reach an agreement on the issues involved in the lawsuit. Mediation may be sought on a voluntary basis or may be ordered by a judge in an attempt to resolve a case without the need for trial.
In arbitration, a neutral third party who is agreed on by both parties, hears evidence at a hearing usually conducted in an office rather than a courtroom. The arbitrator then issues an award, which is final and binding on all parties.
